释义	法律主观：根据《中华人民共和国民法典》第1222条之规定，患者在诊疗活动中受到损害，医疗机构存在篡改病历资料的行为，推定医疗机构有过错。同时《八民会纪要》对上述规定予以细化，即因当事人采取篡改、涂改等方式改变病历资料内容，致使医疗行为与损害后果之间的因果关系或医疗机构及其医务人员的过错无法认定的，改变病历资料一方当事人应承担相应的不利后果。但病历仅存在错别字、未按病历规范格式书写等形式瑕疵的，不影响对病历资料真实性的认定。
