释义	最高人民法院关于贯彻执行《中华人民共和国继承法》若干问题的意见第五十二条规定“继承开始后，继承人没有表示放弃继承权，并于遗产分割前死亡，其继承遗产的权利转移给他的合法继承人”，该条款适用条件如下：1、继承人于被继承人死亡后遗产分割前死亡。2、继承人未丧失继承权，也未放弃继承权。在具备转继承的条件，适用转继承时，转继承人继承被转继承人应继承的遗产。在法定继承中，转继承人应继承的为被继承人的应继份额;若被转继承为遗嘱继承人，则其依合法遗嘱应继承的遗产由转继承人承受。
