释义	法律分析：违约金与定金不能同时并用。当事人既主张约定违约金，又主张定金的，一方违约时，对方可以选择适用违约金或定金条款。定金罚则具有惩罚性，违约金也具有惩罚性，如果同时并用，则有违公平原则的基本精神。如果一方违约造成实际损失，另一方适用定金罚则的同时，可同时请求损害赔偿。” 法律依据：《中华人民共和国民法典》第五百八十八条当事人既约定违约金，又约定定金的，一方违约时，对方可以选择适用违约金或者定金条款。定金不足以弥补一方违约造成的损失的，对方可以请求赔偿超过定金数额的损失。
