释义	法律分析：因商品房质量问题严重影响正常居住使用的，买受人可以请求解除合同和赔偿损失。交付使用的商品房存在质量问题，在保修期内，出卖人应当承担修复责任;出卖人拒绝修复或者在合理期限内拖延修复的，买受人可以自行或者委托他人修复。法律依据：《商品房销售管理办法》第三十五条商品房交付使用后，买受人认为主体结构质量不合格的，可以依照有关规定委托工程质量检测机构重新核验。经核验，确属主体结构质量不合格的，买受人有权退房；给买受人造成损失的，房地产开发企业应当依法承担赔偿责任。
