释义	法律分析: 违章停车是不会被扣驾驶证,扣留驾驶证是有明确的法定情形的。法律依据: 《道路交通安全违法行为处理程序规定》第三十一条有下列情形之一的，依法扣留机动车驾驶证：（一）饮酒后驾驶机动车的；（二）将机动车交由未取得机动车驾驶证或者机动车驾驶证被吊销、暂扣的人驾驶的；（三）机动车行驶超过规定时速百分之五十的；（四）驾驶有拼装或者达到报废标准嫌疑的机动车上道路行驶的；（五）在一个记分周期内累积记分达到十二分的。
