释义	法律分析：实用新型专利权的保护期限为10年，实用新型专利权自申请日起计算，需要注意的是专利权虽然从申请日开始计算，但是生效是从授权公告之日起才生效的，这是由于专利申请必须经过专利局的审查才有可能获得专利权。如果专利权期限届满的话，那么专利权即会终止，同时专利权人在专利权期限届满前也是可以书面声明放弃专利权的。法律依据：根据我国《中华人民共和国专利法》第四十二条规定：发明专利权的期限为二十年，实用新型专利权和外观设计专利权的期限为十年，均自申请日起计算。
