释义	商品在博览会上展出时，展出者拥有指定商品所有商标的优先注册权。商标注册分案申请。指定商品为两种以上时，可以将其中一部分分为一件或两件能上能下的新的申请，新申请被视为于原申请日提出的，在这种情况下，博览会展出证明和优先权证明的提交期间，从新申请日起算。《专利法》第九条同样的发明创造只能授予一项专利权。但是，同一申请人同日对同样的发明创造既申请实用新型专利又申请发明专利，先获得的实用新型专利权尚未终止，且申请人声明放弃该实用新型专利权的，可以授予发明专利权。
