释义	开发商售卖商品房，首先要向相关管理部门办理预售登记，取得《商品房预售许可证》，没有预售许可证的商品房是不能预售的。如果开发商没有取得预售许可证，就将商品房进行买卖，则开发商与买房人签订的商品房买卖合同应该是无效的，买房人可以要求宣告合同无效。法律依据：《最高人民法院关于审理商品房买卖合同纠纷案件适用法律若干问题的解释》第二条出卖人未取得商品房预售许可证明，与买受人订立的商品房预售合同，应当认定无效，但是在起诉前取得商品房预售许可证明的，可以认定有效。
