问题	新婚姻法：精神出轨算不算出轨
释义	2021年1月1日《民法典》施行，旧的婚姻法同步废止。我国《民法典》关于婚姻家庭编并未作出精神出轨的相关规定。法律规定了禁止重婚。禁止有配偶者与他人同居。如果夫妻无过错一方起诉离婚的，那么可以收集出轨一方与他人同居或者与他人有长期的亲密行为的证据，法院可认定夫妻感情确已破裂判决离婚。【法律依据】《民法典》第一千零九十一条有下列情形之一，导致离婚的，无过错方有权请求损害赔偿：（一）重婚；（二）与他人同居；（三）实施家庭暴力；（四）虐待、遗弃家庭成员；（五）有其他重大过错。
