释义	法律分析: 应酬饮酒死亡不算工伤，虽然应酬可能适合工作有联系的一项活动，但是根据规定，饮酒是当事人主观认识到对自己的健康会有伤害的行为，所以不能被纳入到工伤的范畴之中，因为饮酒导致的死亡只能由员工当事人自己负责而不能要求单位和保险赔偿。法律依据: 《工伤保险条例》第十六条职工符合本条例第十四条、第十五条的规定，但是有下列情形之一的，不得认定为工伤或者视同工伤： (一)故意犯罪的; (二)醉酒或者吸毒的; (三)自残或者自杀的。
