释义	按揭贷款购买的商品房，应当将该房屋作为夫妻共同财产直接进行分割处理，而对所欠银行的贷款，可以作为夫妻共同债务，依法进行处理。根据最高人民法院《关于适用若干问题的解释（二）》的规定，这种情况有两种处理形式：1.提前清偿所欠银行的贷款，涂销房屋所有权证书上的他项权登记，这样就可以要求人民法院在处理婚姻问题的同时一并处理房屋的归属问题；2.在双方离婚后，由双方或一方继续偿还贷款，待贷款还清并涂销抵押登记后，双方通过协商或诉至人民法院处理。
