开发商不具备销售许可证预售的房屋该如何处理
释义
法律分析：故意隐瞒没有取得商品房预售许可证明的事实或者提供虚假商品房预售许可证明的情形，导致合同无效或者被撤销、解除的，买受人可以请求返还已付购房款及利息、赔偿损失等。
法律依据：《最高人民法院关于审理商品房买卖合同纠纷案件适用法律若干问题的解释》 第二条 出卖人未取得商品房预售许可证明，与买受人订立的商品房预售合同，应当认定无效，但是在起诉前取得商品房预售许可证明的，可以认定有效。
