释义	根据《民法典》及其其他相关规定，领取结婚证的是男女双方，其他情况法律没有规定。现实情况就是，目前中国尚无同性领取结婚证的先例，而且有同性因此将民政局告上了法庭，结果也是以败诉告终。因此我国大陆法律只保护异性婚姻，不保护同性婚姻，也不承认同性婚姻的法律效力。我国相关法律规定，结婚必须是男女双方，没有将同性恋包括其中。法律依据:《民法典》第一千零四十一条婚姻家庭受国家保护。实行婚姻自由、一夫一妻、男女平等的婚姻制度。
