释义	《民法典》第一千零五十六条规定：“夫妻有互相扶养的义务。一方不履行扶养义务时，需要扶养的一方，有要求对方付给扶养费的权利。”夫妻间的扶养义务是相互的、对等的。夫妻间双方均应自觉地履行，特别是在一方年老、多病或丧失劳动能力、生活困难的情况下，有负担能力的一方，更应主动承担扶养义务。一方不履行扶养义务时，需要扶养的一方，有权要求对方给予扶养。
