释义	票据诈骗罪是指以非法占有为目的，明知是伪造、变造、作废的票据而使用，或冒用他人的票据，或签发空头支票、签发无资金保证的汇票、本票，或捏造其他票据事实，利用金融票据进行诈骗活动，骗取财物数额较大的行为。票据诈骗罪在主观上须由故意构成、且以非法占有为目的。如果行为人出于过失而使用金融票据，如不知是伪造、变造或作废的金融票据、误签空头支票、对票据事项因过失而导致记载错误等，不构成犯罪。根据刑法第200条之规定，单位亦能成为票据诈骗罪的主体。该内容由严达兴律师和法律部落共创回答
