释义	在破产程序中，债权人会议未能依法通过管理人的财产分配方案时，由人民法院裁定。根据企业破产法的规定，有权对该裁定提出复议的债权人是占无财产担保债权总额1/2以上的债权人。【法律依据】《企业破产法》第一百一十六条，破产财产分配方案经人民法院裁定认可后，由管理人执行。管理人按照破产财产分配方案实施多次分配的，应当公告本次分配的财产额和债权额。管理人实施最后分配的，应当在公告中指明，并载明本法第一百一十七条第二款规定的事项。
