释义	法律分析: 根据有关户口管理规定，非特殊情况，小孩出生应随父或‌‌随母落户。如因违反计划生育政策而将小孩户口挂靠亲友，属非法。此情况应注销后再到父亲或随母亲户籍所在地重新申报出生入户。法律依据: 《中华人民共和国户口登记条例》第七条婴儿出生后一个月以内，由户主、亲属、抚养人或者邻居向婴儿常住地户口登记机关申报出生登记。弃婴，由收养人或者育婴机关向户口登记机关申报出生登记。第九条婴儿出生后，在申报出生登记前死亡的，应当同时申报出生、死亡两项登记。
