释义	法律分析: 药品专利保护期为20年。根据我国专利法，发明专利的保护期为20年。专利药的开发和生产受知识产权保护的制约，不能仿制。如果想生产该药品，就必须投入大量资金来生产，或者等到专利期结束。自1993年起，中国实施了新的药品专利法，以保护知识产权和不同程度地保护外国药品。从1950年至今，市场上的新药大多是仿制药，其中97%以上是仿制药。法律依据: 《中华人民共和国专利法》第二十六条申请发明或者实用新型专利的，应当提交请求书、说明书及其摘要和权利要求书等文件。
