法律分析：
属于遗产，而房产赠与和遗产的区别在于：
1，赠与是发生的被继承人生前，其生前将个人财产赠与他人并实际交付或者办理登记手续的为赠与。
2，遗产是被继承人生前所有，在其去世后按其遗嘱或者法定继承方式对其财产进行分配。
3，遗嘱是指被继承人指定法定继承人得到其财产；遗赠指被继承人指定法定继承人以外的人、集体、国家得到其财产。
法律依据：
《中华人民共和国民法典》 第六百五十七条 赠与合同是赠与人将自己的财产无偿给予受赠人，受赠人表示接受赠与的合同。
