释义	法律分析：死亡的继承人是没有继承权的。如果继承人是被继承人子女或者兄弟姐妹的，且继承人比被继承人先死亡的，一般是由继承人的子女继承他父母有权继承的遗产份额。而继承人则没有继承的权利。法律依据《中华人民共和国民法典》第一千一百二十八条被继承人的子女先于被继承人死亡的，由被继承人的子女的直系晚辈血亲代位继承。被继承人的兄弟姐妹先于被继承人死亡的，由被继承人的兄弟姐妹的子女代位继承。代位继承人一般只能继承被代位继承人有权继承的遗产份额。
