释义	法律分析：一般情况下，现役军人的非军人配偶一方提出离婚，必须要得到军人一方的同意，法院才能判决准予离婚。此外，破坏军婚的，已构成犯罪，可追究刑事责任。法律依据：《中华人民共和国民法典》第一千零八十一条现役军人的配偶要求离婚，应当征得军人同意，但是军人一方有重大过错的除外。《中华人民共和国刑法》第二百五十九条明知是现役军人的配偶而与之同居或者结婚的，处三年以下有期徒刑或者拘役。利用职权、从属关系，以胁迫手段奸淫现役军人的妻子的，依照本法第二百三十六条的规定定罪处罚。
