释义	如果在公司申请破产时，股东不同意的话，是不能自行申请破产的。但是，如果在债务企业存在到期债务，出现严重资不抵债、丧失清偿能力的情况下，债权人申请该债务企业破产，则无须经过债务企业股东同意，可以自行申请破产。法律依据：《中华人民共和国企业破产法》第七十条债务人或者债权人可以依照本法规定，直接向人民法院申请对债务人进行重整。债权人申请对债务人进行破产清算的，在人民法院受理破产申请后、宣告债务人破产前，债务人或者出资额占债务人注册资本十分之一以上的出资人，可以向人民法院申请重整。
