释义	刑事案件不是都是公诉。根据《刑事诉讼法》的规定，有一部分刑事案件是自诉案件。自诉案件，即自诉人提起诉讼的案件。中国的自诉案件是告诉才处理的以及其他不需要进行侦查的轻微刑事案件。【法律依据】《中华人民共和国刑事诉讼法》第二百一十条自诉案件包括下列案件：（一）告诉才处理的案件；（二）被害人有证据证明的轻微刑事案件；（三）被害人有证据证明对被告人侵犯自己人身、财产权利的行为应当依法追究刑事责任，而公安机关或者人民检察院不予追究被告人刑事责任的案件。
