释义	法律分析：贷款借据原称“放款借据”。贷款单位支用贷款时给银行出具的书面凭证。具有法律效力，它是在企业和银行双方签订贷款合同的基础上，贷款单位办理每一笔贷款时所必须履行的手续。法律依据：《关于民事诉讼证据的若干规定》第七十条它的效力优于其他的证据且根据一般生活常识，如果双方不存在事实上的借贷关系，借款人也不会随便给借条持有人出具借条，在借款人没有相反的证据足以推翻借条效力的前提下，借条持有人胜诉。
