释义	在人民法院宣告企业破产之前，破产申请人可以请求撤回破产申请。对申请人撤回申请的，人民法院应作出准予或者不准予的裁定，当事人对该裁定不得上诉。人民法院准予申请人撤回破产申请的，在人民法院裁定准予之前，因破产申请所引起的损失，由破产申请人承担。
