释义

法律主观：

劳动者自己也需要缴社保，工伤保险、生育保险除外，由用人单位缴纳。社会保险费中的大部分由用人单位与劳动者共同缴纳，劳动者未到用人单位就业的，则可以以灵活就业人员身份直接向社会保险费征收机构缴纳，但只能缴纳医疗保险费与养老保险费。

中华人民共和国劳动法第七十二条社会保险基金按照保险类型确定资金来源，逐步实行社会统筹。用人单位和劳动者必须依法参加社会保险，缴纳社会保险费。
