2.因为劳动合同履行期间，用人单位解除劳动合同，是否需要提前一个月通知劳动者，要看因为什么原因，依据那条法律规章解除。就比如说双方协商一致解除劳动合同、劳动者严重违法违纪解除合同就不需要提前通知。
3.劳动合同依法订立后，双方当事人必须履行合同义务，守合同的法律效力，任何一方不得因后悔或者难以履行而自解除劳动合同。
