释义	法律分析: 监外执行，是指被判处有期徒刑和拘役的罪犯，由于其具有不宜收监执行的特殊原因，按照法律规定，由居住地社区矫正机构执行，在监外来执行刑罚的一种执行办法。但对于被判处死刑或者死刑缓期2年执行尚未减刑的罪犯，一律不准监外执行。法律依据: 《中华人民共和国刑事诉讼法》第二百五十四条对被判处有期徒刑或者拘役的罪犯，有下列情形之一的，可以暂予监外执行： (一)有严重疾病需要保外就医的； (二)怀孕或者正在哺乳自己婴儿的妇女; (三)生活不能自理，适用暂予监外执行不致危害社会的。
