释义	法律分析：网络诈骗无论金额多少都会立案，数额较小没有达到3000元的，尚不构成诈骗罪，但是违反社会治安，会处五日以上十日以下拘留，并处五百元以下罚款；诈骗行为累计数额超过三千元至一万元以上，就可以追究诈骗罪的刑事责任。法律依据：《中华人民共和国治安管理处罚法》第四十九条盗窃、诈骗、哄抢、抢夺、敲诈勒索或者故意损毁公私财物的，处五日以上十日以下拘留，可以并处五百元以下罚款；情节较重的，处十日以上十五日以下拘留，可以并处一千元以下罚款。
