释义	法律分析：如果是民事案件，在法院立案后，宣判前，原告申请撤诉的，可以向法院提交书面撤诉申请书，是否准许，由人民法院裁定。如果是刑事案件，一般不允许撤销案件，若是公诉案件的，根据法律规定，符合起诉条件的，应当提起公诉；但若存在法定情形的，侦查机关会作出撤销案件的决定。法律依据：《中华人民共和国刑事诉讼法》第一百六十三条在侦查过程中，发现不应对犯罪嫌疑人追究刑事责任的，应当撤销案件；犯罪嫌疑人已被逮捕的，应当立即释放，发给释放证明，并且通知原批准逮捕的人民检察院。
