释义	法律分析：在实际的司法实践中，缓刑期间一般是不会计入刑期的，但是如果已经先行羁押的可以计算入刑期。法律依据：《最高人民法院关于适用〈中华人民共和国刑事诉讼法〉若干问题的解释》第三百五十七第二款人民法院撤销缓刑、假释的裁定，一经作出，立即生效。《中华人民共和国刑法》第四十七条有期徒刑的刑期，从判决执行之日起计算；判决执行以前先行羁押的，羁押一日折抵刑期一日。
