释义	劳务转包是违法的，转包是法律所禁止的行为，承包人非法转包、违法分包建设工程或者没有资质的实际施工人借用有资质的建筑施工企业名义与他人签订建设工程施工合同的行为无效。【法律依据】《建筑法》第六十七条，承包单位将承包的工程转包的，或者违反本法规定进行分包的，责令改正，没收违法所得，并处罚款，可以责令停业整顿，降低资质等级；情节严重的，吊销资质证书。承包单位有前款规定的违法行为的，对因转包工程或者违法分包的工程不符合规定的质量标准造成的损失，与接受转包或者分包的单位承担连带赔偿责任。
