民事、行政枉法裁判罪既遂具体量刑标准?
释义
犯本罪的，处五年以下有期徒刑或者拘役；情节特别严重的，处五年以上十年以下有期徒刑。这里的情节特别严重，一般是指犯罪动机、手段十分恶劣，因枉法裁判而使国家、企业、公民的合法权益受到巨大损害等情况。依照本条第3款的规定，司法工作人员贪赃枉法，犯枉法裁判罪，同时又构成受贿罪的，依照处罚较重的规定定罪处罚。
