释义	法律分析：“无证有照”公司具有市场监督管理部门核准登记的营业执照，但未取得教育行政部门核发的办学许可证，因此，不具备招收中小学生或学龄前儿童开展文化教育培训资质。法律依据：《中华人民共和国教育法》对反违国家有关规定擅自举办民办学校的： 1、由所在地县级以上地方人民政府教育行政部门或者人力资源社会保障行政部门会同同级公安、民政或者工商行政管理等有关部门责令停止办学，由教育行政部门予以撤销; 2、有违法所得，没收违法所得; 3、对直接负责的主管人员和其他直接责任人员，依法给予行政处分。
