释义	空头支票，是指支票持有人请求付款时，出票人在付款人处实有的存款不足以支付票据金额的支票。票据法规定支票出票人所签发的支票金额不得超过其在付款人处实有的存款金额，即不得签发空头支票，这就要求出票人自出票日起至支付完毕止，保证其在付款人处的存款账户中有足以支付支票金额的资金。对签发空头支票骗取财物的，要依法追究刑事责任。如果签发空头支票骗取财物的行为情节轻微，不构成犯罪，票据法规定要依照国家有关规定给予行政处罚。
