《环境保护违法违纪行为处分暂行规定》
第十二条 有环境保护违法违纪行为，涉嫌犯罪的，移送司法机关依法处理。
第十三条 环境保护行政主管部门和监察机关在查处环境保护违法违纪案件中，认为属于对方职责范围内的，应当及时移送。监察机关认为应当给予有关责任人员处分的，应当依法作出监察决定或者提出给予处分的监察建议。
