释义	我国法律以及修改后的法律都充分强调合同当事人意思自治原则，在民间借贷关系中，借贷双方在债权债务关系形成时未约定还款期限，债权人可随时主张权利，债务人可随时履行义务，但不能超过我国法律最长诉讼时效20年的规定。《民法典》第六百七十五条【借款人返还借款的期限】借款人应当按照约定的期限返还借款。对借款期限没有约定或者约定不明确，依据法律第五百一十条的规定仍不能确定的，借款人可以随时返还;贷款人可以催告借款人在合理期限内返还。法律依据《民法典》第六百七十五条
