发现公安机关和派出所违法办案的话可以向纪检监察部门投诉的，或者收集相关的证据材料直接向公安机关上级检察院进行投诉。纪检委在接收到民众的投诉之后应该积极的进行调查，在调查属实的情况下会责令公安机关及时改正，造成损失的要予以赔付。

《中华人民共和国人民警察法》 第四条 人民警察必须以宪法和法律为活动准则，忠于职守，清正廉洁，纪律严明，服从命令，严格执法。
