法律分析：一、定金要本人签字吗
1、定金一般要本人签字，但经依法授权或委托签字的也能生效。如果本人无法签字或者不便于签字的也可以委托他人签字，但是需要出具相应的授权委托书。代签的人如果没有被授权，但是本人追认的，签字也有效。
2、法律依据：
《中华人民共和国民法典》第五百八十六条，当事人可以约定一方向对方给付定金作为债权的担保。定金合同自实际交付定金时成立。定金的数额由当事人约定;但是，不得超过主合同标的额的百分之二十，超过部分不产生定金的效力。实际交付的定金数额多于或者少于约定数额的，视为变更约定的定金数额。
《中华人民共和国民法典》第五百八十七条，债务人履行债务的，定金应当抵作价款或者收回。给付定金的一方不履行债务或者履行债务不符合约定，致使不能实现合同目的的，无权请求返还定金;收受定金的一方不履行债务或者履行债务不符合约定，致使不能实现合同目的的，应当双倍返还定金。
二、定金与订金哪个能退哪个不能退
定金不能退,订金可以退。
目前我国在我国的法律上，订金这个概念是不明确的，但在我国的司法审判实践中，订金一般被视为预付款。简单来说就是，你订金给对方再多，即使你违约了，对方也要退还给你，所以如果是签订的协议上写的是订金，那么你就不用担心，钱肯定能要回来。
法律依据：《中华人民共和国民法典》第五百八十六条，当事人可以约定一方向对方给付定金作为债权的担保。
《中华人民共和国民法典》第五百八十七条，债务人履行债务的，定金应当抵作价款或者收回。
