释义	法律分析: 判刑五年缓刑二年的含义是对于被判处五年有期徒刑的犯罪分子暂不执行刑罚，而是由社区矫正机构执行缓刑二年。在这二年的缓刑考验期限内，如果犯罪分子依法实行社区矫正，没有违反法律规定的，缓刑考验期满，原判的刑罚就不再执行，并公开予以宣告。《刑法》第七十三条拘役的缓刑考验期限为原判刑期以上一年以下，但是不能少于二个月。有期徒刑的缓刑考验期限为原判刑期以上五年以下，但是不能少于一年。缓刑考验期限，从判决确定之日起计算。
