有仲裁条款是不是就必须先申请仲裁解决纠纷
释义
合同约定了仲裁条款的，如果发生纠纷通过调解和协商无法解决的，必须先申请仲裁，然后才能上市。如果不申请仲裁就提起诉讼的，法院是不会受理的，除非约定的仲裁条款无效。
【法律依据】
《仲裁法》第五条，当事人达成仲裁协议，一方向人民法院起诉的，人民法院不予受理，但仲裁协议无效的除外。
