释义	废旧轮胎炼油采用“土法炼油”属于违法行为，另炼油过程中环保不达标，没有办理合法手续私自练油也属于违法行为，若有办理合法手续且环保达标则不违法。法律依据：《废旧轮胎综合利用指导意见》建设和规范废旧轮胎回收体系。各地工业和信息化主管部门要协调有关部门将废旧轮胎回收体系建设纳入公共服务业发展规划，鼓励轮胎生产企业利用新品销售网络建立废旧轮胎回收渠道，加强与废旧轮胎再利用环节的衔接配套；工商联手，禁止废轮胎流入“土法炼油”和“小再生橡胶”生产企业。严禁变相违规进口废旧轮胎。
