释义	特别自首的主体必须是被采取强制措施的犯罪嫌疑人、被告人和正在服刑的罪犯。这里的强制措施是指我国刑事诉讼法所规定的拘传、取保侯审、监视居住、拘留和逮捕等措施。所谓正在服刑的罪犯，是指已经人民法院判决，正在被执行所判刑罚的人。只有上述三种人，才能构成特别自首的主体。对于行为人在被公安机关行政拘留期间如实供述司法机关尚未掌握的其本人罪行的情形，我们认为成立特殊自首。法律依据《中华人民共和国刑法》第六十七条
