释义	法律分析：不能调解，原本是可以调解的，但是自诉案件中存在公诉转自诉的情形，此时没有调解的基础，如果可以调解就剥夺了当事人的上诉权，所以统一规定了不可以调解法律依据：《中华人民共和国刑事诉讼法》第二百一十条自诉案件包括下列案件：（一）告诉才处理的案件；（二）被害人有证据证明的轻微刑事案件；（三）被害人有证据证明对被告人侵犯自己人身、财产权利的行为应当依法追究刑事责任，而公安机关或者人民检察院不予追究被告人刑事责任的案件。
