工伤伤残等级鉴定有时间限制吗，有何相关规定? |

工伤伤残等级鉴定是有时间限制的，一般是工伤认定下来就可以直接去做伤残鉴定，如果用人单位要行政复议，伤残鉴定会暂时中止的。伤残鉴定跟劳动者治疗没有影响，因为伤残鉴定是根据劳动者当时受伤时第一次入院的病历和暂时的康复情况，一般越早做对劳动者的伤残鉴定等级越有利，得到的赔偿越多，法律没有规定必须在什么时候做，但是要在工伤认定结论书生效后一年之内做。具体法律法规规定如下
1、工伤保险条例第二十一条规定，职工发生工伤，经治疗伤情相对稳定后存在残疾、影响劳动能力的，应当进行劳动能力鉴定。
2、工伤鉴定时间是越早越好，越早更有利于申请工伤赔偿，节省申请时间。通常鉴定时效为出险后3-6个月，为有利被保险人考虑，最长不超过6个月。
一般要求伤情稳定后，就可以到劳动能力鉴定机构申请伤残等级鉴定。医疗上一般认为在治疗三个月后，属于稳定需要的最低时间，所以伤残鉴定至少要在工伤治疗三个月之后做，如果有的伤残治疗没有结束，或达不到稳定，还需要继续顺延做伤残鉴定的时间。
一、出了工伤劳动能力鉴定还有效吗
申请工伤劳动能力鉴定是没有时间限制的，因为《工伤保险条例》中规定，职工在伤情相对稳定后认为影响劳动能力的，需要做劳动能力鉴定，可是，伤情稳定的时间是无法通过法律制度约束的，工伤伤残鉴定的时间一般是60天。
