释义	为什么录音不能做证据录音可以作为证据使用。但要分情况而定：若是以侵害他人合法权益或者违反法律禁止性规定的方法取得的证据，不能作为认定案件事实的依据。反而言之，如果未经相关当事人同意的录音录像资料没有侵害到他人的合法权益，也没有违反法律的禁止性规定，则该录音录像资料可以作为定案的根据。相关法律知识《最高人民法院关于民事诉讼证据的若干规定》第六十八条规定：“以侵害他人合法权益或者违反法律禁止性规定的方法取得的证据，不能作为认定案件事实的依据。”
