释义	法律分析：一般情况下，用人单位从用工那天起一个月以上一年以下没有和劳动者订立书面劳动合同的，那么应该向劳动者每月支付两倍的工资。用人单位违反了劳动合同法规定的，不和劳动者订立无固定期限劳动合同的，那么从应该签订无固定期限劳动合同那天起向劳动者每月支付两倍的工资。法律依据：《中华人民共和国劳动合同法》第八十二条用人单位自用工之日起超过一个月不满一年未与劳动者订立书面劳动合同的，应当向劳动者每月支付二倍的工资。
