租房定金不退如何处置？
释义
租房交了定金如果不退的当事人可以主张违约责任，当然肯定需要定金的收据或者合同，只要有证据证明有定金在房东处的，就可以要求房东返还，如果双方协商不成的可以起诉。
法律依据：《中华人民共和国民法典》 第五百八十七条 债务人履行债务后，定金应当抵作价款或者收回。给付定金的一方不履行债务，或者履行债务不符合约定致使不能实现合同目的的，无权请求返还定金；收受定金的一方不履行债务，或者履行债务不符合约定致使不能实现合同目的的，应当双倍返还定金。
