释义	租房押金不退的问题可以双方协商解决，如协商不成，可以收集证据，向法院起诉。在没有有明确约定押金性质的情况下，押金的作用是为房屋及屋内财产设定的一个担保，租赁期间如造成出租人房屋及室内设施的财产损失则从押金里扣除。如果没有造成该损失则合同期满或者解除合同时应予退还。【法律依据】《民法典》第五百七十七条，当事人一方不履行合同义务或者履行合同义务不符合约定的，应当承担继续履行、采取补救措施或者赔偿损失等违约责任。
