释义	法律分析：网贷中可以约定违约金。但是法律有规定违约金加利息不能超过银行同期利率的四倍。如果违约金加利息超过银行同期利率的四倍。法律依据：《中华人民共和国民法典》第五百八十五条约定的违约金过分高于实际损失的，当事人可请求人民法院或者仲裁机构予以适当减少。即一般高于实际损失则无权请求减少，这一方面是为了免除当事人举证的繁琐，另一方面表明法律允许违约金在一定程度上大于损失，显然大于部分具有对违约方的惩罚性。
